1. Introduction

These Terms of Service ("Terms") govern your use of GoodCraft Scan ("Service"), a website analysis tool operated by GoodCraft ("we," "us," or "our"). By using the Service, you agree to be bound by these Terms.

2. Service Description

GoodCraft Scan analyzes publicly available information about websites to provide insights including, but not limited to:

• Performance metrics and page speed data
• Technology stack detection
• Content structure analysis
• Platform migration feasibility assessments

The Service accesses only publicly available information that any visitor to the analyzed website could observe.

3. Authorization Requirement

You represent and warrant that you have proper authorization to scan any website you submit to the Service. This means you either:

• Own the website, or
• Have explicit permission from the website owner, or
• Are an authorized agent acting on behalf of the website owner

You agree not to use the Service to scan websites without proper authorization. Unauthorized scanning of third-party websites may violate applicable laws and these Terms.

4. Acceptable Use

You agree NOT to use the Service to:

• Scan websites you do not own or have authorization to analyze
• Gather competitive intelligence on third parties without their consent
• Conduct any form of reconnaissance for malicious purposes
• Overwhelm or disrupt target websites through excessive scanning
• Violate any applicable laws, regulations, or third-party rights
• Resell, redistribute, or commercialize scan results without our written consent

5. Scan Data and Results

5.1 Your Data

Scan results generated for websites you are authorized to analyze belong to you. You may use these results for your own business purposes, including making decisions about website migrations or improvements.

5.2 Aggregate Data

We may collect and use anonymized, aggregate data about website technologies and trends for our own business purposes, including improving the Service and creating industry reports. This data will not identify you or any specific website you scan.

5.3 Data Retention

We retain scan results for 90 days. You may request deletion of your scan history by contacting us.

6. No Guarantees

The Service is provided "as is." We make no warranties regarding:

• The accuracy or completeness of scan results
• The suitability of any platform recommendation
• The feasibility or cost of any website migration
• Uptime or availability of the Service

Scan results are informational only and should not be the sole basis for business decisions. We recommend professional consultation for significant website projects.

7. Limitation of Liability

To the maximum extent permitted by law, GoodCraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Decisions made based on scan results
• Any issues arising from website migrations
• Loss of business or revenue
• Third-party claims related to your use of the Service

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the fees you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

8. Indemnification

You agree to indemnify, defend, and hold harmless GoodCraft, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Scanning websites without proper authorization

9. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by GoodCraft and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

10. Modifications

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Knox County, Tennessee.
